1. Vorbemerkung
Diese Geschäftsbedingungen gelten für sämtliche Geschäftsbeziehungen aus den Warenlieferungen von Psychofon Records/ Christina Schenk, Dionysiusstraße 63, D-27576 Bremerhaven
2.Vertragsschluss
2.1
Der Kunde gibt mit seiner Bestellung ein verbindliches Angebot zum Abschluss eines Vertrags ab. Ein Vertrag kommt jedoch erst durch Absendung der Ware oder durch unsere ausdrückliche Annahme des Angebots mit der Auftragsbestätigung, innerhalb von 5 Tagen ab Bestellung zustande.
2.2
Der Vertragstext wird nach Vertragsschluss von uns gespeichert und kann vom Kunden bei Psychofon Records abgerufen werden.
2.3
Bei elektronischen Bestellungen bestätigen wir den Zugang von Bestellungen automatisch. Diese Zugangsbestätigung stellt keine Bestellannahme im Sinne von Ziffer 2.1 dar.
2.4
Es gibt keinen Mindestbestellwert.
3. Zahlungsbedingungen
3.1
Paypal (die Zahlung erfolgt mit der Bestellung, Differenzgutschriften erstatten wir am Versandtag auf dein Paypal-Konto). Kreditkarte (VISA, Euro / Mastercard – die Belastung erfolgt mit der Bestellung, Differenzgutschriften erstatten wir auf deine Kreditkarte). Bei Bestellungen aus dem Ausland über den Online-Shop kann nur per PayPal oder Kreditkarte bezahlt werden. Für deutsche und europäische Kunden ist auch eine Direktüberweisung auf unser Postbank Konto möglich.
3.2
Sofern eine Bezahlung per Rechnung vereinbart ist, ist diese sofort und ohne Abzug fällig, sofern nicht anders vereinbart.
3.3
Unsere Preise sind freibleibend und verstehen sich inkl. der derzeit gültigen Mehrwertsteuer, zuzüglich Verpackungs- und Versandkosten. Generell gilt: Berechnet wird der Preis, der zum Zeitpunkt der Bestellung auf unserer Webseite gelistet ist. Etwaige Schreib-, Druck-, oder Rechenfehler bleiben vorbehalten.
4. Lieferung
4.1
Wir versenden ausschließlich per Deutsche Post AG an die vom Kunden im Rahmen der Bestellung angegebene Adresse.
4.2
Die bestellte Ware wird innerhalb von 5 Tagen ab Zahlungseingang versendet. Sofern einzelne Artikel nicht sofort verfügbar sind oder längere Lieferzeiten haben, ist dies in der Artikelbeschreibung vermerkt. Wir behalten uns vor, limitiert lieferbare Artikel nur in haushaltsüblichen Mengen auszuliefern.
4.3
Ist der Kunde Unternehmer, geht die Gefahr des zufälligen Unterganges und der zufälligen Verschlechterung des Leistungsgegenstandes auf den Kunden über, sobald die Ware zum Transport abgegeben ist. Dies gilt unabhängig davon, ob die Versendung vom Erfüllungsort aus erfolgt und wer die Transportkosten zu tragen hat. Befindet sich der Kunde in Annahmeverzug, so geht die Gefahr bereits ab Mitteilung der Versandbereitschaft über.
4.4
Sollte die Zustellung aus vom Kunden zu vertretenden Gründen nicht möglich sein, sind wir berechtigt, die Kosten für den Zweitversand in Rechnung zu stellen. Es ist möglich, eine Alternative-Lieferadresse anzugeben, um solche Probleme zu vermeiden.
4.5
Teillieferungen sind nur nach Vereinbarung bzw. Zustimmung zulässig.
5. Eigentumsvorbehalt
5.1
Wir behalten uns bei allen Lieferungen das uneingeschränkte Eigentum bis zur vollständigen Erfüllung sämtlicher Zahlungsverpflichtungen durch den Kunden vor.
6. Gewährleistung / Haftung
6.1
Innerhalb der gesetzlichen Gewährleistungsfrist ist es zunächst nur möglich, Nachbesserung oder Ersatzlieferung zu verlangen.
6.2
Soweit wir zur Nachbesserung oder Ersatzlieferung nicht bereit oder in der Lage sind oder dies aus anderen Gründen fehlschlägt, ist der Kunde berechtigt, nach seiner Wahl vom Vertrag zurückzutreten oder eine angemessene Herabsetzung des Kaufpreises (Minderung) zu verlangen.
6.3
Weitergehende Ansprüche des Kunden, insbesondere Schadensersatzansprüche wegen verspäteter oder unterbliebener Lieferung, sind ausgeschlossen. Dies gilt nicht, soweit die Schadensursachen auf von uns zu vertretendem Vorsatz oder grober Fahrlässigkeit beruhen oder bei Verletzung von Leben, Körper und Gesundheit.
7. Schlussbestimmungen
Vertragssprache ist Deutsch.

General Terms and Conditions
1. preliminary remark
These terms and conditions apply to all business relations arising from the delivery of goods by Psychofon Records/ Christina Schenk, Dionysiusstraße 63, D-27576 Bremerhaven, Germany.
2.conclusion of contract
2.1
With his order the customer makes a binding offer to conclude a contract. However, a contract shall only be concluded by dispatch of the goods or by our express acceptance of the offer with the order confirmation, within 5 days of the order.
2.2
The contract text will be stored by us after the conclusion of the contract and can be retrieved by the customer at Psychofon Records.
2.3
In case of electronic orders we automatically confirm the receipt of orders. This confirmation of receipt does not represent an order acceptance in the sense of paragraph 2.1.
2.4
There is no minimum order value.
3. terms of payment
3.1
Paypal (payment is made with the order, we will refund any difference credits to your Paypal account on the day of shipment). Credit card (VISA, Euro / Mastercard - the charge is made with the order, we will refund the difference to your credit card). For orders from abroad via the online store, payment can only be made via PayPal or credit card. For German and European customers a direct transfer to our Postbank account is also possible.
3.2
If payment by invoice is agreed, it is due immediately and without deduction, unless otherwise agreed.
3.3
Our prices are subject to change and include the currently valid VAT, plus packaging and shipping costs. In general, the price that is listed on our website at the time of the order will be charged. We reserve the right to make any typing, printing or calculation errors.
4 Delivery
4.1
We ship exclusively by Deutsche Post AG to the address specified by the customer in the order.
4.2
The ordered goods will be shipped within 5 days after receipt of payment. If individual items are not immediately available or have longer delivery times, this is noted in the item description. We reserve the right to deliver limited items only in household quantities.
4.3
If the customer is an entrepreneur, the risk of accidental loss and accidental deterioration of the object of performance shall pass to the customer as soon as the goods have been handed over for transport. This shall apply irrespective of whether the shipment is made from the place of performance and who has to bear the transport costs. If the customer is in default of acceptance, the risk shall pass as soon as the customer is notified that the goods are ready for shipment.
4.4
If delivery is not possible for reasons for which the customer is responsible, we shall be entitled to charge the costs for the second shipment. It is possible to provide an alternative delivery address to avoid such problems.
4.5
Partial deliveries are only permissible by agreement or consent.
5. reservation of proprietary rights
5.1
We reserve unrestricted ownership of all deliveries until the customer has fulfilled all payment obligations in full.
6 Warranty / Liability
6.1
Within the statutory warranty period, it is initially only possible to demand rectification or replacement.
6.2
Insofar as we are not willing or able to rectify the defect or make a replacement delivery, or if this fails for other reasons, the customer shall be entitled, at his discretion, to withdraw from the contract or to demand a reasonable reduction of the purchase price (abatement).
6.3
Further claims of the customer, in particular claims for damages due to delayed delivery or failure to deliver, shall be excluded. This shall not apply if the causes of damage are based on intent or gross negligence for which we are responsible or in the event of injury to life, limb or health.
